Certain personal injury lawyers broadcast their
immense success in trials and push clients to ‘go to court’ to get a fair and
just outcome. On the other hand, some personal injury lawyers urge their
clients to accept the ‘out of court’ settlement offered by the defendant.
The latter lawyers may have probably never set foot inside a court and often seem unwilling to go to trial. The problem is that insurance companies are aware that the lawyer will never go to court and try to get away with low settlement offers. Therefore, the plaintiff is denied the full value of his case.
Then again, the former category of trial lawyers may not be very skilled at negotiating. They uphold that a judge will hand out a high value verdict in the lawsuit. However, trials often prove to be risky, expensive, and unnecessarily prolonged. In fact, barely 2% of personal injury lawsuits are actually tried before the court.
